Privacy Policies and Your Website: Everything You Need to Know

What is a Privacy Policy, Why is it Legally Required, and Where to Get One

Website compliance can be a real snooze-fest ūüėī. Listen, I get it! You want the beautiful site you see so many other business owners sporting, but you don’t want the headache of the compliance that goes along with it.

As a website designer, I totally get it! Trust me, I didn’t start designing websites to have to deal with the legal compliance of them either. But in today’s world, it’s unavoidable. Keep reading and I’ll give you all the information you need to know about what they are, why you need one, and where to get one.

What is a Privacy Policy?

A Privacy Policy is a document or page on your website that discloses what personal information you collect on your website, what you do with that information, and who you share it with, amongst other disclosures.

Why do you need one?

It’s required by law.

Privacy Policies help you comply with various data protection laws, such as the General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA). Plus…

Colorado recently passed the Colorado Privacy Act and it goes into effect July 1, 2023.

Many other states have their own privacy laws as well, but if your business is located in Cheyenne, Wyoming, or the surrounding areas – the Colorado laws will most likely affect you if you ever have Colorado residents visit your site.

Other states that have their own privacy laws include:

  • California. California led the charge in being the first state to enact comprehensive data privacy legislation via the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA).
  • Indiana
  • Iowa
  • Montana
  • Oregon
  • Tennessee
  • Texas
  • Utah

If your business is located in any of these states, it is even more crucial that you have a proper privacy policy in place.

Where do you get one?

If you have the budget, we recommend hiring a lawyer who focuses on privacy law to write your website policies, monitor privacy laws, and update your policies when the laws change or when new laws go into effect.

If you¬†do not¬†have the budget to hire a privacy lawyer (as most small businesses don’t), we have two recommendations…

1. The Creative Law Shop

The Creative Law shop provides legally-sound contracts that are drafted and developed by a practicing attorney – without the hourly rate. This allows you to purchase attorney-drafted contracts at a fraction of the cost of hiring your own attorney.

For Service-Based Businesses –¬†We recommend¬†The Website Basics Bundle, which includes a Privacy Policy and Website Terms & Conditions contract templates.

For E-Commerce Businesses –¬†We recommend¬†The Online Shop Bundle, which includes a Privacy Policy, Website Terms & Conditions, and Terms & Conditions for online sales contract templates.

For Course Providers – We recommend The Online Course Bundle, which includes a Privacy Policy, Website Terms & Conditions, and Terms & Conditions of Online Courses

Privacy Policies can be purchased individually, but you save money by bundling! No matter which one you purchase, you will receive the contract templates in a Word document, with highlighted areas indicating where you need to add information that is specific to your business. You will also receive lifetime updates to your contracts. If and when the laws change, you can simply log in to your contract portal and download the latest version of the contract template.

The Contract Law Shop also provides dozens of other contract templates for service-based businesses in the creative industry. Anything from contracts for photographers, to wedding professionals, to affiliate programs, to coaching, to hairstylists and so much more! These contract templates are a great investment to protect your business, without having to hire an attorney to draft them for you. Plus, they’ve been reviewed and refined by professionals in each respective industry.

Use code NORTH10 for 10% off your contract templates.

2. Termageddon

Termageddon is a subscription-based privacy policy generator that will¬†automatically¬†update your website’s policies whenever the laws change. This is great because privacy laws are continually changing! As a busy business owner, it’s probably not at the top of your to-do list to follow up on privacy laws and update the privacy policy on your website. If you’re anything like me, you had a ‚Äúset it and forget it‚ÄĚ mentality when you launched your website. But it’s no longer that easy!

USE code NDESIGN at checkout for 10% off your first year.

Fines for violations of privacy laws begin at $2500 per violation (per website visitor).

This information is not meant to scare you! We are simply trying to inform you of the latest laws that affect your website and your business. And we are here to help! If you have any questions at all about this stuff, just hit reply!

Stay safe in the online world!
